Create an EU administrative court of justice against regulatory capture.

For those who don’t know what regulatory capture is:

It’s a widely acknowledged way markets fail and protect themselves from competition.

Having a court that has the ability to launch investigations and conduct independent discovery (e-discovery) to strike down regulations that lead to regulatory capture would go a long way to destroy barriers to entry and enable innovation.

Implementing this would give the EU a huge advantage over the US, where regulatory capture is practiced by senators as a means to get campaign support.

    For clarity, this would be similar to how the administrative courts of justices work in national countries to strike down unconstitutional laws or protect civilians against the government applying their rules selectively.

    In this case, it would give entrepreneurs the ability to file a complaint with the court and the court can investigate and strike down regulation that protects entrenched interests.
